Perc Vol: 5

1502.01000 – In General
PERB Regulations do not require that more than technical assistance be given to public notice complainants. Legal representation by Board agents is not required.
1502.02000 – Initial Proposals
Request to meet and negotiate do not have to be physically attached to an initial proposal to conform to public notice requirements. Allegation that the number of copies of union's initial proposal was inadequate is dismissed where 20 copies were available and distributed to the public and the District retained copies for public inspection.
1502.05000 – Public Input
No evidence shown that District's three-minute rule (for public speakers addressing proposals) was insufficient. District allowed public input at two governing board meetings.
1502.10000 – Remedies
The Board may assess litigation expenses against a public notice complainant who repeatedly files nonmeritorious complaints and abuses Board processes.
